A self-managed super fund is a trust that holds your retirement savings and reports to two regulators: the ATO for tax and compliance, and ASIC for the corporate trustee, if you use one. Set it up wrong, and the fund can be declared non-compliant, which taxes the assets at 45 per cent instead of the concessional 15 per cent.

Most of the mistakes happen in the first month. The trust deed is a template pulled off the internet with a clause that fails the sole purpose test. The trustee declaration is not signed within 21 days. The bank account is opened in a personal name because the ABN has not come through yet, and contributions land in the wrong entity. Each of these is fixable at setup and expensive to fix later.

What does not change is the standard: a compliant deed, a correct trustee structure, ATO registration inside the window, and a bank account opened before rollovers land.

Trust Deed Drafting

SMSF-specific trust deed drafted for your fund, not a template with your name pasted on it. Sole purpose test, member and trustee provisions, contribution and pension rules, and binding death benefit nomination clauses all reviewed against the current SIS Act.

Trustee Structure Decision

Individual trustee or corporate trustee. We work through the ownership, succession and cost implications with you and document the choice. A corporate trustee needs an ACN and director IDs before ATO registration can happen. We handle both.

ABN and TFN Registration

Fund registered with the ATO for an ABN and TFN as an ATO-regulated SMSF, lodged within the 60-day window from the date the trust deed is signed. We use our Registered Tax Agent access, so the registration goes through the agent lodgement channel.

Trustee Declarations

Each trustee, or each director of the corporate trustee, must sign the ATO trustee declaration within 21 days of appointment. We prepare the declarations, walk you through the duties, and keep the signed original with your fund records for the required retention period.

Fund Bank Account Setup

Bank account opened in the fund's name once the ABN is issued. This is the account that holds all contributions and rollovers, separate from any personal or business finances. We coordinate directly with the bank so the account is ready before your first rollover lands.

Investment Strategy and Rollovers

Written investment strategy signed off by the trustees before any investment is made. We coordinate the rollover of your existing super into the SMSF bank account, so the money moves in the correct order and no contribution is treated as a personal contribution by mistake.

WHEN AN SMSF ACTUALLY MAKES SENSE

An SMSF is not a better super fund by default. It is a different vehicle with different work attached to it, and there are situations where it saves you real money and situations where it costs you more than it earns.

The commonly cited threshold from ASIC's Moneysmart is around $200,000 in combined member balances. Below that, the fixed setup and annual compliance costs erode returns faster than an industry fund's percentage-based fee. Above it, the cost per dollar starts to look competitive, and the strategic benefits become real.

Adelaide members most commonly register a fund for four reasons: to buy a direct residential or commercial property using super, to hold business real property that the member's own business operates from, to gain access to investment classes an industry fund does not offer, such as unlisted shares or physical metals, and to use pension-phase strategies that need a fund controlled by the member.

The reasons that usually do not stand up are wanting to save fees on a small balance, wanting to invest in one particular stock, and wanting more control without wanting the compliance work. All three are worth discussing before you commit to a setup.

INDIVIDUAL TRUSTEE OR CORPORATE TRUSTEE?

This is the first structural decision you make when setting up an SMSF, and the one people get wrong most often. The choice affects setup cost, ongoing cost, asset protection, and how easy it is to add or remove a member later.

The two structures differ in five practical ways:

    Setup cost: individual trustee is cheaper up front by roughly $530, the current ASIC company registration fee.

    Ongoing cost: corporate trustee attracts an annual ASIC review fee of $71 if the company acts solely as super fund trustee.

    Membership: an individual trustee needs at least two other people. A single-member fund must use a corporate trustee or add a second individual trustee.

    Changing members: with individual trustees, every asset title has to be updated when a trustee is added or removed. With a corporate trustee, only the director changes.

    Penalties: administrative penalties under section 166 of the SIS Act apply per trustee, so a four-member fund with individual trustees faces four times the penalty of a corporate trustee for the same breach.

If you are setting up an SMSF as the sole member, a corporate trustee is usually the practical choice. An individual trustee needs a second person, and that second person is either your spouse (who becomes a member with contribution and pension implications) or a family member who must agree to assume legal responsibility for a fund they have no interest in.

    Multi-member funds still often go corporate

    Two-member funds save the ASIC fee up front with individual trustees, but the moment a trustee dies, divorces, or moves overseas, every asset title in the fund has to be re-registered. That cost usually eats up the setup savings within five years, which is why most of the Adelaide funds we register end up corporate.

      Director ID reminder: Every director of a corporate trustee must obtain a director ID from the Australian Business Registry Services before the fund is registered with the ATO. The ATO's SMSF registration reviews now reject funds where the director does not hold an ID, so this step happens before, not after, the trust deed is signed.

      HOW WE REGISTER YOUR SMSF

      Registering an SMSF is mostly about getting the sequence right. Trust deed before ATO registration. ABN before bank account. Bank account before rollover. Here is the process we follow, from the first meeting to the first invested dollar.

      Initial consultation

      We work through your position: current super balances; the reason you want an SMSF; whether an industry fund with Member Direct would do the same job for less work; who the members and trustees will be; and whether the fund will hold property. The fee is quoted before any registration work starts.

      Trustee structure and director IDs

      Individual trustee or corporate trustee decision documented. If corporate, we arrange director IDs through Australian Business Registry Services and register the ACN with ASIC. Director IDs must be issued before the ATO registers the fund.

      Trust deed drafting and execution

      SMSF-specific trust deed prepared for your fund. Every member and trustee signs. The signing date starts the 60-day clock for ATO registration and the 21-day clock for trustee declarations.

      ATO registration for ABN, TFN and SMSF status

      Fund lodged with the ATO through our Registered Tax Agent channel. The application covers ABN, TFN, and registration as an ATO-regulated super fund. Trustee declarations signed and stored within the 21-day window.

      Bank account and electronic service address

      Once the ABN is issued, we open the fund's bank account in the fund's name and register the electronic service address that allows employers and other funds to send contributions and rollovers to your SMSF.

      Investment strategy and first rollover

      Written investment strategy prepared and signed by all trustees before any investment is made. Rollovers from your existing super are then requested through the ATO's SMSF verification service, which prevents rollovers to the wrong fund.

      SMSF setup fees depend on the trustee structure and any related work that needs to be done alongside registration, such as a bare trust for a property purchase or a rollover from an existing industry fund. Any firm quoting a single number without asking about your situation is guessing.

      Technically yes, but the compliance risk is significant. The trust deed must satisfy the sole purpose test and the current SIS Act. Each step has a penalty regime attached, and the ATO's SMSF registration reviews now reject funds where the paperwork is incomplete or out of sequence. Most people who set up their own fund end up paying an accountant to fix it later.
      An individual trustee requires at least two people, costs less at setup, but requires that every asset title in the fund be updated whenever a trustee changes. A corporate trustee costs more up front (an ASIC registration fee of $538 plus an annual review fee of $71 when the company acts solely as a super fund trustee), can operate with a single director, and only requires the director to change when a member joins or leaves. Most Adelaide funds we register use a corporate trustee.
      ASIC's Moneysmart guidance suggests that around $200,000 in combined member balances is the point at which SMSF fixed costs start to compete with an industry fund's percentage-based fees. Below that, the annual audit and compliance work usually costs more than the savings in fees. Above it, the strategic benefits (direct property, business real property, control over investment classes) become the reason to have the fund, not the fees.
      Yes. An SMSF can buy residential or commercial property outright or through a limited recourse borrowing arrangement using a bare trust structure. Business real property (commercial property that the member's business operates from) has additional concessions available. Any property purchase requires the bare trust to be structured before the contract is signed, which is one of the reasons we register funds for property purchases as a coordinated setup rather than in stages.
      The trustee declaration is a prescribed form under regulation 6.17 of the SIS Regulations. Each trustee, or each director of the corporate trustee, must sign it within 21 days of appointment to confirm they understand their duties under the SIS Act and consent to act as trustee. The declaration is retained for the life of the fund plus 10 years, and the ATO can request it during compliance reviews.
      Yes. Once the fund is registered, we handle ongoing SMSF administration through our separate SMSF administration service: annual return preparation, audit coordination with an approved SMSF auditor, TBAR reporting for pension-phase members, and trustee compliance support.
