Not-for-profit organisations that meet the ATO's eligibility criteria may be exempt from income tax. The exemption does not apply automatically. Your organisation must either self-assess as income tax-exempt based on its structure and activities, or apply to the ATO for endorsement of an income tax exemption. Registered charities with ACNC registration are generally income-tax-exempt. Incorporated associations and community clubs may also qualify depending on their purposes. See the ATO's guidance on NFP tax concessions for the full eligibility framework.
The Australian Charities and Not-for-profits Commission (ACNC) is the national regulator and registry for charities. Registration with the ACNC is required if your organisation wishes to be recognised as a charity for federal tax purposes, which enables access to income tax exemption, DGR endorsement, GST concessions, and FBT rebates or exemptions. Registration is not compulsory for all NFPs, but it is a prerequisite for most significant charity tax concessions. See the ACNC registration page for the registration process and requirements.
A Deductible Gift Recipient (DGR) is an organisation endorsed by the ATO to receive tax-deductible donations. When your organisation has DGR status, donors can claim a tax deduction for gifts of $2 or more. There are 50-plus DGR categories in Australian law, each with specific eligibility requirements. Most charities apply through the ACNC registration process. For some categories, your organisation must also be listed on a specific government register. See the ATO's DGR endorsement page for the complete list of categories and requirements. We assess which DGR category is appropriate for your organisation and manage the application.
Salary packaging allows NFP employees to receive part of their remuneration as non-cash benefits rather than salary, reducing their income tax liability. For employees of Public Benevolent Institutions, up to $15,900 per year in non-entertainment benefits can be packaged free from FBT under the FBT exemption for PBIs. For other registered charities, the FBT rebate arrangement provides a similar effective benefit. Common salary packaging benefits include mortgage or rent payments, personal loan repayments, and credit card payments. The benefit to the employee is a reduction in taxable income equal to the packaged amount, which at a 32.5% marginal rate represents over $5,000 per year in additional take-home pay on a $15,900 package.
Under the Associations Incorporation Act 1985 (SA), incorporated associations must keep financial records and prepare financial statements that give a true and fair view of the association's financial position. Associations with annual receipts or payments of $500,000 or more must have their financial statements reviewed or audited by a registered company auditor. All associations must present financial statements to members at the annual general meeting and lodge an annual return with Consumer and Business Services SA. The Kalculators prepares financial statements for Adelaide incorporated associations in accordance with these requirements and can coordinate the review or audit process for larger associations.
Most not-for-profit organisations must register for GST if their annual turnover from business activities exceeds $150,000, which is a higher threshold than the $75,000 that applies to for-profit businesses. Registered charities and gift-deductible entities can access specific GST concessions for NFPs, including GST-free treatment for sales of donated goods and GST concessions for raffles and fundraising events. The GST treatment of each income stream varies significantly depending on whether the activity is a business, charitable, or fundraising activity.
